LEGAL ADVISORY RESPECTING FALSE REPORTING

The Department of the Environment is providing this Regulatory Information Submission System (RISS) for the purpose of electronic reporting. By activating the “Proceed” button below, any person entering, editing, altering or otherwise submitting any information to the Department through this website, understands that the provisions of the Fisheries Act and the Canadian Environmental Protection Act, 1999 apply to RISS reporting. See, for example, subsection 63(1) of the Fisheries Act (making a false or misleading statement) and subsection 273(1) of the Canadian Environmental Protection Act, 1999 (providing or filing false or misleading information). Persons using this website should consult the Fisheries Act and the Canadian Environmental Protection Act, 1999 for all purposes of interpreting and applying the law.

LEGAL AUTHORITY OF MINISTER TO COLLECT INFORMATION IN ELECTRONIC FORMAT

The Department is providing this Regulatory Information Submission System for the purpose of electronic reporting. The authority of the Minister to collect information through RISS (an electronic means) is provided by:

Section 9 of the Pulp and Paper Effluent Regulations that requires mill owners and operators to report monitoring results “… in written form, or where an electronic format is provided by the Department of the Environment, in the electronic format.”

Section 23 of the Metal Mining Effluent Regulations that requires mine owners and operators to report monitoring results “… in writing and in the electronic format, if any, provided by the federal Department of the Environment.”

PRIVACY STATEMENT

The Government of Canada (GoC) and Environment Canada are committed to respecting the personal privacy of individuals who visit our Web sites. This page summarizes the privacy policy and practices of Environment Canada Web sites.

  • Environment Canada does not automatically gather any personal information from you, such as your name, phone number, or e-mail or street address during your visit to our Web sites. This information is only obtained if you supply it, usually through contacting us via e-mail, or registering in a secure part of the site. When you submit sensitive information, such as that required in a monthly effluent quality monitoring report, we protect confidentiality by using 128-bit secure socket layer (SSL) encryption to code the information.

  • Subject to the provisions of the Access to Information Act and Privacy Act, any information collected is kept confidential by Environment Canada. At the point of final submission of information you will be advised that your information is being collected and the purpose for which it is being collected. The information is not disclosed to anyone except our officers who need the information to respond to a request. Environment Canada does not disclose the information to any party inside or outside the federal government unless authorized by law.

  • Our RISS application server does not use cookies to collect personal data about visitors to our Web site. (A “cookie” is a file that may be placed on your hard drive without your knowledge by a web site to allow it to monitor your use of the site.) Technology dictates that the server is aware of a visitor's ISP (Internet Service Provider), but this gives us no information of any kind about the individual user. However, some of our secure servers do use session management methods exclusively to support secure electronic transactions.

  • Environment Canada employs software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. This software receives and records the Internet Protocol (IP) address of the computer that has contacted our Web site, the date and time of the visit and the pages visited. We make no attempt to link these addresses with the identity of individuals visiting our site unless an attempt to damage the site has been detected.

  • Environment Canada is a participant in the GoC Public Key Infrastructure (PKI), which gives you the opportunity to communicate with the Department in a confidential manner.

DISCLAIMER ON ACCURACY OF PPER HISTORICAL DATA

The records stored in this Regulatory Information Submission System include data on the results of effluent quality monitoring and pulp and paper production, and any calculations derived from the data that were submitted to the Minister of the Environment by paper mill owners and operators pursuant to section 9 of the Pulp and Paper Effluent Regulations. The records also include calculations made by the Department that are derived from the data received.

The mode of submission over the years has varied from paper hardcopy to electronic spreadsheets transmitted over e-mail. An Inspector or Fishery Officer transferred the data from the original submission to the Department's electronic storage and processing computer applications. Quality control measures have been employed to insure the information conformed to processing requirements. For example, text was removed from any field strictly reserved for numerical values. Whenever possible, the Department consulted with the mill operator who submitted the data in question to effect necessary changes. In most cases, revision activity is well documented and appears in an appropriate "Notes" field. Multi-stage quality control efforts have been employed to insure the integrity of the data transferred from the original submissions to RISS, but the Department gives no guarantee that the data transferred is completely accurate.
